1. Welcome to next:chapter

Welcome to next:chapter, an online community for buying and selling preloved fashion in the United Arab Emirates.

These Terms & Conditions govern your access to and use of the next:chapter website, accounts, listings, messaging and other services (together, the "Platform").

By creating an account or using the Platform, you agree to these Terms, our Privacy Policy, Buyer Protection & Refund Policy, and Prohibited Items & Listing Rules.

If you do not agree, please do not use the Platform.

2. Who we are

next:chapter is a UAE-focused peer-to-peer marketplace currently in development.

Website: www.nextchapteruae.ae
Email: hello@nextchapteruae.ae

Legal operator: [Insert registered legal entity name, licence number, licensing authority and registered business address before commercial launch.]

next:chapter provides technology that allows individuals to list, discover and, once enabled, purchase preloved fashion from other individuals.

Unless expressly stated otherwise, next:chapter does not own, purchase, store, inspect, authenticate or sell items listed by members.

3. Current beta availability

The Platform is currently undergoing testing.

During the beta phase:

  • Members may create accounts, browse listings and test available features.
  • Real purchases, payment collection, seller payouts and paid Buyer Protection are not yet active.
  • Any simulated checkout, order or payment process is for testing only.
  • No simulated order creates an obligation to deliver an item or pay a seller.
  • Features may be changed, interrupted or removed during testing.

Members must not interpret a simulated payment or order confirmation as a completed purchase.

The commercial marketplace will launch only when the necessary business, payment and operational arrangements are in place.

4. Eligibility and accounts

You must be at least 18 years old to create an account.

By registering, you confirm that:

  • You are at least 18 years old.
  • The information you provide is accurate and up to date.
  • You have the legal capacity to enter into transactions.
  • You will use the Platform lawfully.
  • You will not create an account on behalf of another person without appropriate authority.

You are responsible for keeping your login credentials secure and for activity carried out through your account.

You must notify us promptly if you suspect unauthorised access.

We may request reasonable verification information where necessary to protect members, prevent fraud or meet legal and payment-provider requirements.

5. Private individual sellers

At launch, next:chapter is intended for private individuals selling their own preloved fashion.

Commercial retailers, professional resellers, businesses and individuals regularly selling goods as a business may not sell without our prior written approval and any required licences.

Sellers must have the legal right to sell every item they list.

Sellers are responsible for ensuring that their activities comply with applicable UAE laws, including any licensing, tax or other obligations that apply to them.

6. Creating a listing

Sellers must provide accurate information about each item, including:

  • Brand, where applicable
  • Category and size
  • Condition and signs of wear
  • Material, where known
  • Any damage, defects, alterations or missing parts
  • Genuine photographs of the actual item
  • The asking price in AED
  • Available collection or delivery methods

Photographs must accurately represent the item being sold. Stock images must not replace photographs of the actual item.

Sellers must not knowingly misrepresent an item's authenticity, condition, origin or value.

Each listing must comply with our Prohibited Items & Listing Rules.

We may review, edit the presentation of, restrict or remove listings that breach these rules, pose a safety risk or require further verification.

7. Prices and fees — planned commercial service

Listing items will be free.

Our planned fee structure is:

Seller commission: 0%
Buyer Protection fee: 5% of the item price plus AED 2 per order

For example, an item priced at AED 100 would have a Buyer Protection fee of AED 7, giving a total of AED 107 before any separately arranged delivery costs or applicable taxes.

The buyer will see the applicable fee and total payable before confirming a purchase.

Delivery charges agreed directly between buyers, sellers and independent couriers are not included in the Platform's fee unless expressly stated.

Any applicable taxes or legally required charges will be displayed or accounted for as required by law.

We will publish confirmed fees before enabling real transactions.

8. Buying items — planned commercial service

When purchasing becomes available, buyers will be responsible for reviewing the listing, photographs, condition, size, price and available delivery methods before placing an order.

A purchase is subject to payment authorisation, seller availability and the applicable transaction process.

Sellers must not accept payment for an item they cannot provide.

Orders may be cancelled, paused or refunded where required by law or where fraud, prohibited goods, non-fulfilment or other serious issues are identified.

The exact order acceptance and cancellation process will be confirmed before commercial launch.

9. Payments and seller payouts — planned commercial service

next:chapter intends to use an authorised third-party payment provider, potentially Mamo, to process buyer payments and arrange seller payouts.

The payment provider may require identity, bank account or other verification information.

The payment provider's applicable terms may also govern the transaction.

next:chapter does not currently operate a payment-holding or escrow service and does not represent that customer funds are held in a regulated escrow account.

Before live transactions begin, we will disclose:

  • The confirmed payment provider
  • Who receives and processes buyer payments
  • When seller payouts become payable
  • How payment disputes, refunds and chargebacks are handled
  • Any payment-provider verification requirements

Seller payouts may be delayed where a transaction is disputed or where verification, fraud prevention or legal compliance requires it, subject to the confirmed payment arrangement and applicable law.

10. Collection and delivery — planned commercial service

Sellers may offer one or both of the following methods:

Self-collection: The buyer and seller agree on a collection location and time.

Arrange a courier: The buyer and seller agree on an independent courier, collection and delivery details, and the applicable costs.

The available methods will be displayed on each listing.

next:chapter does not currently book couriers, operate a delivery fleet or provide courier insurance.

Buyers will normally pay initial delivery costs, unless the parties agree otherwise before purchase.

Users must communicate delivery arrangements clearly and should use the Platform's messaging service wherever possible.

For self-collection, we recommend agreeing on a safe, public location. Members should not feel obliged to disclose their home address.

For courier delivery, the parties are responsible for selecting a suitable service, providing accurate information and retaining relevant tracking or collection evidence.

Responsibility for loss or damage, and any reimbursement or claim process, will be governed by our Buyer Protection & Refund Policy, applicable law and the terms of the selected courier.

11. Confirming receipt — planned commercial service

Buyers will be asked to confirm when an item has been received or collected.

The planned Buyer Protection inspection period is 48 hours from verified receipt.

The precise rules for independently verified delivery, disputed receipt and cases where the buyer does not confirm receipt will be published before real transactions begin.

A seller's statement that an item was dispatched will not, by itself, establish that the buyer received it.

12. Buyer Protection, disputes and returns — planned commercial service

Eligible purchases completed through the Platform will be subject to our Buyer Protection & Refund Policy.

The planned protection covers qualifying cases where an item:

  • Is not received
  • Is counterfeit
  • Is the wrong item
  • Has significant undisclosed damage
  • Is significantly different from its listing

Buyers must report eligible issues within the applicable period, except where mandatory legal rights require otherwise.

A change of mind, personal preference or fit issue is not ordinarily grounds for a return where the item was accurately described.

Nothing in these Terms removes or restricts rights that cannot lawfully be excluded.

13. Communication and member conduct

Members must treat one another respectfully.

The following are prohibited:

  • Harassment, threats, abuse or discrimination
  • Fraud, impersonation or misleading representations
  • Requests for passwords, verification codes or unnecessary personal information
  • Sharing another person's private information without authority
  • Sending spam or unsolicited commercial messages
  • Attempting to manipulate reviews, orders or listings
  • Using the Platform for unlawful purposes

When real transactions become available, purchases intended to receive next:chapter Buyer Protection must be completed through the Platform's authorised checkout.

Members who choose to arrange payments outside the Platform will not receive next:chapter's contractual Buyer Protection for those payments, without affecting any rights available under applicable law.

14. Personal information

We process personal information in accordance with our Privacy Policy.

Public profiles and listings must not expose private home addresses, personal identification documents, banking credentials or unnecessary contact information.

Information shared to arrange a transaction must be used only for that legitimate purpose and must not be disclosed, retained or used for unrelated marketing.

15. Intellectual property

The next:chapter name, branding, website design, text and other original Platform materials belong to the relevant rights holders and may not be copied or commercially exploited without permission.

Sellers retain ownership of their own photographs and listing content.

By uploading content, sellers grant the Platform a non-exclusive, royalty-free licence to host, reproduce, display, format and promote that content for the purposes of operating and marketing the Platform.

This licence ends when the content is removed, except where limited retention is reasonably required for completed transactions, disputes, backups or legal obligations.

Sellers confirm that they have the rights necessary to upload and license their content.

16. Platform availability

We aim to provide a reliable service but cannot guarantee uninterrupted access.

We may perform maintenance, introduce new features or suspend functionality where reasonably necessary.

During beta testing, features may be incomplete or unavailable.

17. Account suspension and closure

We may restrict or suspend an account where reasonably necessary because of suspected fraud, unlawful activity, serious or repeated rule breaches, security concerns or legal requirements.

Where appropriate, we will explain the reason and provide an opportunity to contact us.

Members may request account closure by contacting hello@nextchapteruae.ae or using any available account deletion feature.

Certain information may need to be retained for legal, financial, security or dispute-resolution purposes.

18. Responsibility and liability

Sellers are responsible for the accuracy, authenticity, legality and condition of their items.

next:chapter provides marketplace services and does not ordinarily act as the seller of the listed goods.

However, we remain responsible for our own services and for any obligations imposed on us by applicable law.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including applicable consumer protection obligations or liability for fraud.

Any further limitations of liability must be reviewed and finalised before commercial launch.

19. Changes to these Terms

We may update these Terms to reflect changes in our services, legal requirements or operating procedures.

We will publish the updated version with a revised date.

Where changes materially affect members' rights or obligations, we will provide appropriate notice and obtain renewed acceptance where required.

20. Governing law and disputes

These Terms are intended to be governed by applicable laws of the United Arab Emirates.

The appropriate court jurisdiction and dispute-resolution wording will be finalised after the operating company's place of incorporation and licensing authority have been confirmed.

Nothing in this section limits mandatory consumer rights or access to competent regulatory authorities.
